1. Who these terms are between
These terms govern the relationship between Lucas Lorilleux, a self-employed professional established in Spain, trading as “Mallorca Concierge”, and clients requesting service arrangements.
2. Definitions
Provider: the independent third-party service suppliers who actually deliver a service. Provider Service: the service delivered by a Provider. Coordination Service: the intermediary arrangement work carried out by Mallorca Concierge.
3. Our role — intermediary, not the provider, not a travel agency
We act solely as an intermediary and coordinator, in your name and on your behalf. Contracts form directly between clients and Providers. We are neither operator, travel agency, nor package-tour seller. Provider selection uses reasonable care, without guarantees.
4. Requests, quotes and confirmation
Bookings require your express agreement to a specific quote. Availability and pricing remain subject to Provider confirmation until finalised.
5. Prices, our fee and payment
You pay the Provider directly unless we tell you otherwise. Our compensation derives from Provider commissions. We do not hold Client money. Cash payments cap at €1,000 under Spanish law.
6. Changes, cancellations and refunds
Changes and cancellations of a Provider Service are governed by that Provider’s own policy. Coordination fees remain non-refundable once the service has been arranged.
7. Your responsibilities
You must provide accurate information, maintain valid documents, confirm you are 18 or over, obtain adequate insurance, and behave lawfully toward Providers.
8. Liability
We are responsible for performing the Coordination Service with reasonable skill and care. Our liability is limited to the greater of the fees we received or €1,500, with statutory consumer protections preserved.
9. Tourist accommodation
Properties must hold a valid Balearic tourist-letting registration (ETV). Contracts exist directly between clients and property owners or managers.
10. Force majeure
Neither party is liable for events beyond reasonable control, including severe weather, natural events, strikes, transport disruption, acts of authority, or outbreaks of disease.
11. Complaints and dispute resolution
Contact contact@mallorca-concierge.com. Consumers may access official complaint procedures and the relevant Balearic authorities.
12. Data protection
Personal data is handled as described in our Privacy Policy. Clients consent to Provider data-sharing where necessary to deliver the requested service.
13. Governing law and courts
These terms are governed by Spanish law. The courts of Palma de Mallorca have jurisdiction. Statutory EU consumer protections apply where applicable.
14. Business clients
Business arrangements exclude consumer-specific protections. Liability and jurisdiction provisions may differ from consumer arrangements.
15. General
These terms may be updated with notice for future bookings. This document together with the Privacy Policy and any specific quote constitutes the complete agreement.
